« Win $50 HBC Gift Card » Contest Rules and Regulations
123win! Inc. (the « Organizer« ), administrator of the Website 123win.ca (the « Site« ), is organizing a contest titled « Win $50 HBC Gift Card » (the « Contest« ).
Duration: Contest starts on April 1, 2015 at 01:00:01 a.m. EST (the Contest « Start Date« ) and ends on May 31, 2015 at 11:59:59 p.m. EST (the Contest « End Date« ) – the « Contest Period« . Organizer reserves the right to change the duration of the Contest.
Eligibility: This contest is open to all residents of Canada who are 18 years of age or older at the time of entry, or 13 years of age and older with parental consent. Entrants must not be an employee of, a member of the immediate family and/or persons domiciled with an employee of 123win! Inc. or any of their advertising and promotional affiliates.
To qualify as a participant (the « Participant« ) in the Contest, one must be a registered member of 123win.ca (hereinafter the « Member« ), log-in to his/her account, and follow the link to enter the contest by clicking on the « Enter to Win! » button.
Limit one (1) entry (the « Entry« ) per day for each Participant. Participation is prohibited by any automated system and if a member uses such a system will be excluded from the contest. Any attempt by any Participant to secure more entries through multiple Member accounts, or any other method will result in disqualification of the Participant from the Contest and the closure of their 123win.ca Member account.
Prize: Participants are eligible to win one (1) $50 HBC Gift Card (the « Prize”). Prize must be accepted as awarded and is not transferable or refundable. The Organizer reserves the right to substitute the Prize of equal value in the event that the Prize described is unavailable due to circumstances beyond their control. No purchase necessary.
Prize will be awarded by random draw (the « Draw« ) from amongst all eligible entries by the Contest End Date. The Draw will be conducted by electronic means, which ensure the random selection and the inability of the human factor intervention. The Draw will be held at the Organizer’s office within ten (10) days from the contest End Date. The Draw will determine (1) selected Participant (the « Selected Participant« ) and five (5) alternative Participants (the « Alternate Participants« ).
The Organizer assumes no responsibility for any direct or indirect loss, damage, injury or costs and expenses that may arise from the use of the Prize.
To be officially declared a winner (the « Winner« ) of the Contest, the Selected Participant must complete and return a prize acceptance form (the « Prize Acceptance Form« ), including correctly answering a mathematical skill-testing question within ten days after they are being contacted by e-mail from the Organizer or an Alternate Participant will be selected.
If the Selected Participant has received an invitation (the « Invitation« ) to join in 123win.ca by another Participant (the « Referrer« ) then both the Selected Participant and the Referrer are potential Prize winners.
The odds of winning depend on the number of eligible Entries. All entries that are incomplete, illegible, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by Organizer. Organizer takes no responsibility for lost, delayed, or late entries, or for typographical or other production errors. All Entries become the property of 123win.ca.
By entering the Contest, Participants (and/or their parent or legal guardian) agree to abide by the Contest Rules and all decisions of the Organizer, which are final. Prizes will be awarded and delivered to the confirmed winners by the Organizer. The Winner (and/or their parent or legal guardian) agrees to authorize Organizer to announce and publish their name, address (city only) in any forthcoming publicity in connection with this promotion without further remuneration. Potential Winners (and/or their parent or legal guardian) will be required to release 123win.ca, and their agencies and representatives from liability with respect to the Contest and the Prize. Failure on the part of a Selected Participant (and/or their parent or legal guardian) to return the affidavit by the deadline as posted on the release form may result in disqualification of that person and an Alternate Participant will be selected from among all remaining eligible entries.
All entries become the property of 123win.ca, which assumes no responsibility for incomplete, lost, late, damaged, illegible or misdirected entries or email, nor for technical, hardware or software failures of any kind, lost or unavailable network connection, or failed, incomplete, garbled or delayed computer transmissions which may limit a user’s ability to participate. Organizer reserves the right, in its sole discretion, to cancel or suspend this Contest should a virus, bug, computer problem, unauthorized human intervention or other cause beyond Organizer’s control, corrupt the administration, security, fairness or proper play of the Contest. In the event of early termination of the Contest, a notice will be posted on-line and a random drawing to award all Prizes will be conducted from among all eligible entries received prior to the time of termination. Organizer reserves the right to modify the Contest or disqualify Participant if fraud, misconduct or technical failures destroy the integrity of the Contest as determined by the Organizer, in its sole discretion. In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the email address submitted at the time of entry (i.e. the person who is assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domains associated with the submitted email address.
Contest is subject to all applicable Federal, Provincial, Municipal and local laws and regulations.
For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
